JF Event Rental Agreement Terms and Conditions

In this agreement, “JF Event” refers to JF Event Rental and its employees, and “customer” refers to the customer, its agents, and/or employees. By hiring the rental items described in this Rental Agreement, the following terms and conditions are agreed upon:

1. Indemnity/Hold Harmless:

   – Customer assumes responsibility for the rented items and agrees to indemnify, defend, and hold JF Event harmless from any liability, claims, judgments, attorneys’ fees, and costs arising from the use, maintenance, operation, possession, ownership, or rental of the items.

2. Assumption of Risk/Release – Discharge of Liability:

   – Customer acknowledges the risk of injury or damage and voluntarily assumes all risks associated with the use or operation of the rented items, releasing JF Event from any responsibility or liability for such injury or damage.

3. Operators:

   – No operators are provided, directly or indirectly, with the rental items.

4. Receipt/Inspection of Rental Items:

   – The customer acknowledges receiving the rental items on an “as is” basis and agrees to inspect the items before use. The customer confirms the items’ suitability and good working order.

5. Possession/Title:

   – Customer’s right to possession begins upon the items leaving JF Event and ends on the Agreed Return Date. Retention of possession after this date constitutes a breach. Title to the items remains with JF Event.

6. Rental Period/Rate/Payment:

   – Additional fees apply for greater usage than agreed. JF Event may terminate the rental at any time for violation of terms. The customer agrees to pay all collection and dispute-related costs.

7. Proper Care:

   – Customer is responsible for all damage to rental items, including damage due to misuse, overloading, lack of cleaning, and other factors.

8. Compliance with Law/Use of Rental Items:

   – Customer agrees to use rental items legally, comply with laws and regulations, and obtain necessary permits. JF Event has no responsibility to inspect items while in the customer’s possession.

9. Return of Rental Items:

   – Customer agrees to return items in good condition by the Agreed Return Date. Customer is liable for damages and costs incurred in recovering damaged items.

10. Disclaimer of Warranties:

    – JF Event makes no warranties, expressed or implied, and is not responsible for any loss, damage, or injury resulting from the operation or use of the items.

11. Sub-Rental/Location of Rental Items:

    – Customer agrees not to sublet or assign the items from the agreed-upon location.

12. Default:

    – JF Event may terminate the agreement, retake items, and initiate legal proceedings in case of customer default.

13.Retaking of Rental Items:

    – JF Event is authorized to retake items without notice in case of default, and the customer agrees not to hold JF Event liable for any claims arising from item removal.

14. Legal Fees:

    – If legal action is taken, the prevailing party (determined to be JF Event) is entitled to recover reasonable attorney’s fees and court costs.

15. Damage Waiver Plan:

    – The Damage Waiver Plan is not insurance and can be declined. Certain conditions are not covered, and the plan does not relieve the customer of responsibility for damages.

16. Payment for Loss or Damage:

    – Customer is responsible for all lost or damaged items. Damaged items will be held for inspection, and customers will be advised of discrepancies within 48 hours.

17. Notice of Non-Waiver/Severability:

    – Failure to enforce any provision does not waive the right to enforce others. Provisions are severable.

18. Terms & Conditions of Sale:

    – Applies only to sold items, not rented. No warranties are made, and items are sold on an “As Is” basis.

19. Moving of Non-Rental Items:

    – JF Event is not liable for damage resulting from moving non-rental items requested by the customer.

20. Marking Underground Utilities:

    – Customer is responsible for marking underground utilities before delivery. JF Event is not liable for damages to customer or site property during installation.
